PRIVACY NOTICE

Effective on March 1, 2018

This statement (“Privacy Statement”) governs your use of the Compology website at https://compology.com/ and https://app.compology.com/ (the “Site”) and the Compology mobile application (the “App”).  The Site and the App allow you to receive information about, and, if you enter into a Services Agreement with Compology (“Services Agreement”), to obtain, access and use, the Compology waste management system (the “Compology Services”).

What information does Compology collect and how is it used?

You can visit the Site to read information about our company and the Compology Services without telling us who you are and without revealing any personal information.

User Provided Information: the “Site”

You may voluntarily provide contact information such as your name, email, phone number, company information, etc. to access additional content or information. Compology may use the information you provide us to contact you from time to time to provide you with information, required notices, marketing or for our internal analytics purposes.

User Provided Information: the “App”

After entering into a Services Agreement with Compology, when you create an account on the Site and download the App in order to obtain, access and use the Compology Services, you must provide your name, job title (optional), email address and password.  In order to obtain the Services, you must also provide Customer Information (as defined in the Services Agreement), which includes personal information, via the Site.  Compology and its third party contractors use the information you provide to make the services available to you on the terms in the Services Agreement.  We may also use the information you provide us to contact you from time to time to provide you with important information, required notices, or for our internal analytics purposes.

Automatically Collected Information

In addition, the Site and the App may collect certain information automatically.  We automatically receive and record information from your web browser when you interact with the Site.  That information might include your IP address, your browser type and version, your operating system and version, and the website or service that referred you to the Site, and information from cookies and Web beacons (clear GIFs) on the Site.  We or our third party contractors use this information to allow visitors to enjoy more seamless visits, more accurately measure visitor behavior on the Site, and to detect and prevent fraudulent activity.  Users who disable their Web browsers’ ability to accept cookies will still be able to browse the Site; however, they will not be able to log in as registered users or to make use of the App.  The App collects automatically information such as the type of mobile device you use, your mobile device’s unique user ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and your time zone.  We or our third-party contractors may use this information only as necessary to provide information to your mobile device in connection with the Services.

Compology does not collect personally identifiable information about your online activities over time and across third-party websites or online services.

Does the App collect precise real time location information of the device?

This application does collect precise information about the location of your device, using the “location services” function of your device.  Compology uses this information in order to provide the Services to you.   You must allow such use in order to obtain the Services.

Do third parties see and/or have access to information obtained by the Site and the App?

We may disclose user provided and automatically collected Information:  (a) as required by law, such as to comply with a subpoena, or similar legal process; (b) when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud; (c) with our third party services providers who work on our behalf, for the purpose of providing our Services, and for no other purpose; and (d) if some or all of Compology’s business or assets are sold or otherwise transferred, to the buyer or transferee.

Automatic Data Collection

We may work with analytics companies to help us understand how the Site and the App are being used, such as the frequency and duration of usage.  Our third party contractors use some of the information collected by the Site and the App to assist Compology in providing the Services.

What are my opt-out rights?

You can stop all collection of information (a) by the Site by not using the Site and (b) by the App by uninstalling the App.  You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.  You will not be able to obtain, access or use the Services without use of the Site and the App.

You may at any time opt-out from further allowing us to have access to your location data by going to the location services, under “settings,” on your mobile device and turning location services off.  You will not be able to make full use of the Services without providing access to your location information via the App.

Security

Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Third Party Sites

The Site and the App contain links to other websites.  Compology is not responsible for the privacy practices or the content of these other web sites.  You should check the privacy policy statements of these other web sites to understand their policies.  If you access a linked site, you may be disclosing your private information.

Changes

This Privacy Statement may be updated from time to time for any reason.  We will notify you of any changes to our Privacy Statement by posting the new Privacy Statement on the Site.  You are advised to consult this Privacy Statement regularly for any changes.  If you are a party to a Services Agreement with Compology, any provisions of this Privacy Statement that are inconsistent with the Services Agreement are superseded by the provisions of the Services Agreement.

Your Consent

By visiting and creating an account on the Site, and by downloading the App, you are consenting to our processing of information as set forth in this Privacy Statement now and as amended by us.

California Residents:  Under California law, California residents who have an established business relationship with Compology may opt out of Compology disclosing personal information about them to third parties, including to Compology subsidiaries and affiliated companies, for their marketing purposes.  Compology does not disclose information to third parties, including its subsidiaries and corporate affiliates, for their marketing purposes.
